1. Service Scope

Balysta is an AI platform in test phase. The platform uses Artificial Intelligence (AI) to extract and structure financial information from Brazilian balance sheets (Balanço Patrimonial and related statements). The service is currently provided free of charge and may change or be discontinued at any time.

2. Account Access

Access to Balysta is granted via an invitation system. Users may register on a waiting list and receive an invitation with one-time password (OTP) login. Users are responsible for maintaining the confidentiality of their email account used for login. Balysta reserves the right to suspend, block, or delete user accounts at its sole discretion, including in cases of misuse, suspected abuse, or inactivity.

3. User Responsibilities

• Only upload documents you are legally authorized to process.
• If documents contain personal data of third parties (e.g., accountants, employees), you must ensure you have the necessary legal basis or consent from the data subject to process such data via Balysta and its third-party providers.
• Do not misuse the platform for unlawful purposes or upload harmful content (malware, prohibited files, or abusive material).

4. Use of Data, Logs, and Security

By using Balysta, you acknowledge that we may process uploaded documents, extracted outputs, metadata, and usage logs to improve and test our services. We may use such data in anonymized or aggregated form for statistical and performance analysis. For documents uploaded by users, Balysta acts predominantly as a Data Processor, processing information on behalf of the user (Controller), exclusively for the technical purposes described in Balysta's Privacy Policy.

4.1. Security Measures

Balysta adopts appropriate technical and organizational measures to protect processed data, including, where applicable:

• encryption of data in transit and at rest;
• access control restricted to authorized personnel;
• logical environment segregation;
• monitoring and logging of technical activities.

These measures aim to prevent unauthorized access, loss, alteration, or improper disclosure of data.

4.2. Security Incidents

In the event of a security incident that may pose a risk or relevant harm to data subjects, Balysta will take appropriate measures to mitigate the impact and will notify affected users and, where applicable, the National Data Protection Authority (ANPD), as required by the LGPD.

5. Disclaimer & Limitation of Liability

• Balysta is provided 'as is' during its test phase, without warranties of any kind.
• Extracted data may be incomplete or inaccurate.
• Balysta does not replace professional accounting or auditing.
• Users remain fully responsible for validating outputs and for any financial, legal, or business decisions made based on them.
• Because the service is provided free of charge and exclusively for testing, Balysta's liability is strictly limited.
• To the fullest extent permitted by law, Balysta shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
• In any case, considering that the service is provided free of charge and exclusively for testing purposes, Balysta's total liability shall be limited to the amount actually paid by the user for the use of the service, which currently corresponds to R$ 0.00 (zero reais)

6. Intellectual Property & Data Use

• Users retain ownership of the original PDF documents they upload.
• Balysta retains ownership of all technology, algorithms, methods, and processes used to extract and structure data.
• The structured output generated by Balysta is provided under a limited, non-exclusive license to the user for their internal business purposes.
• Nothing in these Terms grants users any rights to Balysta's software, algorithms, or intellectual property.
• By using Balysta, users grant Balysta a non-exclusive, worldwide, royalty-free license to use uploaded documents, extracted outputs, and associated usage logs in anonymized or aggregated form for the purpose of improving and developing the platform.
• Balysta does not use documents uploaded by users to train generalist AI models. Processing occurs in an isolated manner, focused on the specific extraction and structuring requested by the user.

7. Governing Law

These Terms are governed by the laws of Brazil.
